Road Transport Terms & Conditions

Definitions

Supplier
Wags Gear – the carrier providing the transport services.

Customer
The person, business, or entity engaging Wags Gear to provide transport services.

Goods
Any items transported by Wags Gear, including trailers, boats, motors, parts, accessories, or related freight.

Services
Freight, transport, loading coordination, delivery, and related services provided by Wags Gear.

Pickup Party / Delivery Party
Any dealer, sender, supplier, receiver, yard, depot, or third party responsible for loading or unloading the Goods.

GST
Goods and Services Tax.


1. Booking Transport

How to Book

Transport bookings can be submitted via:

Information Required for Bookings

When booking transport, please provide:

• Business name
• Pickup address
• Delivery address
• Length of trailer or boat (including if a motor is fitted)
• Requested pickup date

Providing accurate information helps us plan routes and schedules.


Booking Notice

Customers should provide as much notice as possible when booking transport so scheduling and coordination can be arranged efficiently.


Booking Confirmation

Transport bookings are confirmed by email once accepted.

A booking is only confirmed once all details are finalised including pickup and delivery locations.

Any booking changes must be agreed in writing by both parties.


Loading and Unloading Requirements

Pickup and delivery locations must have suitable equipment available to safely load and unload the Goods.

If a forklift or lifting equipment is not available, any additional costs such as forklift hire or labour will be the responsibility of the Customer.


Additional Charges, Variations & Delays

Additional charges may apply where delays or changes occur outside Wags Gear’s control, including:

• waiting time
• standby time
• additional services not originally included
• service changes
• re-attempted collections or deliveries
• extra stops
• site access issues
• loading or unloading delays

All additional charges are payable by the Customer.


Waiting Time

Waiting time applies where the transport vehicle is delayed at pickup or delivery locations beyond normal loading or unloading time due to circumstances outside Wags Gear’s control.

Examples include:

• queues or site delays
• restricted access
• no authorised receiver available
• paperwork or release documentation not ready

Waiting time is charged at $80 per hour (GST inclusive)
Charged in 15 minute increments with a minimum 30 minute charge.


Standby – Goods Not Ready

Standby applies where the Pickup Party confirms the Goods are ready but they are not ready when the driver arrives.

Examples include:

• no forklift or operator available
• Goods not staged or prepared
• paperwork not ready

Standby is charged at $120 per hour (GST inclusive)
Charged in 15 minute increments with a minimum 30 minute charge.


Responsibility for Charges

All waiting time, standby, variation and additional service charges are payable by the Customer, regardless of whether the delay is caused by the Pickup Party or Delivery Party.


Cancellations

Cancellations made 48 hours or more before pickup will not incur a cancellation fee.

Cancellations made within 48 hours of scheduled pickup may incur full payment.

Deposits are non-refundable once the booking has been confirmed.


2. Pricing and Payment

Pricing

Transport pricing is based on the information provided at the time of booking including the Goods details and pickup and delivery locations.

Unless stated otherwise, pricing excludes:

• variations
• additional services
• extra stops
• re-attempted collections or deliveries
• waiting time
• standby
• fuel levy
• any other charges referred to in these Terms.


Payment Terms

Payment is due within 48 hours of delivery, unless otherwise agreed in writing.


Fuel Levy

A fuel levy may be applied due to changes in diesel prices and operating costs.

The levy is reviewed weekly and may change from time to time.

Customers will be advised of the current fuel levy by email and it will appear as a separate line item on quotes or invoices.

Any fuel levy is payable in addition to the quoted transport charges.


Deposits

A deposit may be required to secure a transport booking.

If required, the deposit amount will be stated on the quote or invoice.


Payment Methods

Accepted payment methods include:

Cash
Bank Deposit
Visa
Mastercard

Card payments incur a 1.7% + 30c transaction surcharge.


Late Payment Fees

Late payments incur a $55 per day late fee until the account is paid in full.


3. Shipping and Delivery

Proof of Delivery

The Customer or their representative must provide a signature confirming receipt of the Goods at delivery.


Responsibility After Delivery

Once proof of delivery is obtained, Wags Gear’s responsibility for the Goods ends unless loss or damage is proven to have been caused by negligence.


Reporting Delivery Issues

Any delivery issue must be reported in writing within 12 hours of delivery, including:

• damage
• shortages
• non-receipt

Reports outside this time period may not be accepted.


4. Liability

Wags Gear is only liable for loss or damage where it is directly caused by negligence.

Where permitted by law, liability is limited to the lesser of:

• the repair cost
• the replacement cost
• the declared value of the Goods

Wags Gear is not liable for indirect or consequential losses including loss of income, business interruption or loss of profit.


5. Insurance

Wags Gear holds Goods in Transit insurance covering loss or damage caused by proven negligence, subject to policy terms, limits and exclusions.


6. Confidentiality

Both parties agree to keep confidential any commercial or sensitive information obtained during the transport services unless disclosure is required by law or authorised in writing.


7. Force Majeure

Wags Gear will not be liable for delays or failure to perform services caused by events beyond reasonable control including:

• natural disasters
• flood
• fire
• strikes
• war
• pandemics
• equipment failure
• road closures
• government action.


8. Termination

Either party may terminate services by written notice.

If transport has already been scheduled, cancellation fees or other charges may still apply.


9. Miscellaneous

These Terms constitute the entire agreement between the Customer and Wags Gear.

Any changes to these Terms must be agreed in writing.

If any provision of these Terms becomes invalid or unenforceable, the remaining provisions will continue to apply.

Wags Gear may update these Terms from time to time. The latest version will always be available on the website.


10. Privacy and Customer Communications

We may collect personal and business information to provide quotes, arrange transport, send invoices, process payments and communicate about our services.

This may include:

• name
• business name
• email address
• phone number
• pickup and delivery details
• billing information
• transaction history

We use systems such as Xero to manage quotes, invoices, payments and account records.

We use Omnisend to send fuel levy updates only.

We take reasonable steps to protect your information and only use it where necessary to provide our services or meet legal obligations.


11. Acceptance

By booking transport, accepting a quote, paying a deposit, paying an invoice or instructing Wags Gear to proceed with services, the Customer confirms they have read and agree to these Road Transport Terms & Conditions.
